TERMS OF SERVICE

By commissioning me, you are agreeing to the terms of service below.

This agreement is set in good faith between I, Jino, The Artist, and you, the Client, for rigging services performed on the the project commissioned through me.//Timeline & ProcessThe completion of this project requires 20 at minimum, and may take more or less days depending on the complexity and workload of the commission. Deadlines and timelines will be adhered to in good faith but may not be possible sometimes. Note that each project may vary. I highly suggest that the client should plan the launch (debut) and streams accordingly.There may be 2 major revision(s) for each commission, not including mistakes made by the Artist. I will actively reach out for feedback.Any additional charge may be required for further revisions that may impact the progress and timeline of the commission.Delivery of the Fully-Rigged Live2D model will be through email.

CommunicationCommunications between the Artist and the Client will take place throughout the entire project timeline. I will typically ask for feedback when I have something to show and I will let you know if anything is causing delays or priority shifts in during the commission.I will use E-Mail, Twitter DMs, and or Discord DMs, Trello page to facilitate communications. Should there be any method of communication aside from the above, and agreed on both party, will also be used to facilitate communication on updates. I will typically respond quickly discussions but implementing changes may take up to a day, to facilitate in order to provide the best and concrete update.Clients agree to provide all required art, references, information, and assets that is needed for Rigging purposes before the commission starts and during the process, or it might affect both the timeline and the result.

Rights, Usage, and CreditsArtist Rights
I retain the original credit of the model rigging, which includes but may not be limited to advertising and displaying in my websites, social media and portfolios, according to my discretion.The process [Work in Progress/Rigging in Progress] will likely be posted i.e on Twitter and/or streamed or uploaded on Youtube or Twitch or my other social media platform unless Clients request otherwise before project begins. Any NDA or confidential commission status may be a subject to an additional $50 on top of the base price.

Client RightsClients are granted exclusive rights for personal use of the finished model rigging file as agreed upon, which must not be transferred to any other parties unless agreed upon between the Artist and the Client. Personal use includes: Using it for streams and videos.Clients may not claim the rigging model as anyone else's nor their own, and therefore must credit me as the Rigging Artist using JINO/Blackwall Jin, or link to my twitter/website on Social Media.

Commercial RightsCommercial license are exclusively given to the Client, which includes usage of the fully rigged model on streams, broadcast contents, or any monetized work (i.e including but not exclusive to: merchandise, monetized videos, music releases).Reselling rights are not included. Reselling rights means selling the ready-to-use Fully Rigged Live2D Model file to another party or another platform or on any platform.

Unwanted Chargebacks
Any unwanted chargeback or refund made, that were not previously discussed and agreed upon will result in that client losing all commercial rights and will have the model be up for sale.
